October Annual Update: Record Retention Best Practices for Employee Benefit Plans: How Much and How Long?

Several statutes of limitations pertain to employee benefit plans under federal law, but ERISA’s open-ended requirement to maintain employee-specific benefits determination records goes well beyond those limitation periods. Eric and Anna will discuss prudent record retention policies and risk management strategies for retirement plans and other employee benefit plans in light of potential participant claims and agency audits. They will also highlight the legal compliance opportunities created by the new IRS pre-examination pilot program, which provides a 90-day window for plan sponsors to self-correct certain operational issues before an audit begins.
