Beachfront Home Owners' Property Lines Present Challenges for Businesses

On April 22, Portland Press Herald published an article, "Lawsuit could settle debate over who owns Maine beaches between low- and high-tide lines," explaining that Maine's top court decided beachfront home owners own the land to the tide's low-tide line. This has presented challenges for business like rockweed harvesting and therefore a lawsuit was filed in Cumberland County Superior Court to challenge the law on beach ownership in Maine.

Environmental attorney, Gordon Smith was quoted in the article, stating "These are sort of speculative academic arguments that are inconsistent with how people have treated property for hundreds of years and also arguments that the court has seen and rejected on more than one occasion. I don’t think that there is really a legitimate chance of these arguments succeeding."
