Rackemann attorney Brian M. Hurley was quoted in the Law360 article, “Massachusetts Cases To Watch In 2021,” which outlined the most noteworthy cases from 2020 that will continue to unfold in the new year.

One such high-profile case concerns the “Right to Repair” law, the automotive ballot question that was passed by voters in November. Despite overwhelming support for the revision at the polls, the Alliance for Automotive Innovation, which represents General Motors Co. Toyota Motor Corp. and Volkswagen AG, among others, has already filed suit against Attorney General Maura Healey in federal court, seeking to block the law from going into effect. Opposers of the law cited its unconstitutionality in regards to manufacturers’ proprietary information. “I think it’ll be a very good battle and it involves some intriguing first impression issue,” said Hurley. “The core issue is: Who owns the data and who has the right to control it?”
