California Diaper Co. Can't Dodge Massachusetts FCA Suit

Paul Shaw is quoted extensively in an August 20, 2018 article from Law360 entitled "California Diaper Co. Can't Dodge Massachusetts FCA Suit" about a False Claims Act case against Shield HealthCare Inc. Mr. Shaw, along with other attorneys in Verrill Dana's Health Care Group, represents Massachusetts relators to the case, in which it is alleged that Shield is accused of hiding manufacturer rebates and overbilling government insurance. The article discussed a U.S. District Judge Rya W. Zobel ruling that the charges against Shield may proceed despite a request from Shields' counsel for judgment based on their assertion that these are copycat claims and should not proceed. Paul is quoted in the article, "It's one of the first post-Escobar where there's a ruling that the failure to comply with billing rules in and of itself can be determined to be material."

The case in question is U.S. et al. v. Coloplast AS et al., in the U.S. District Court for the District of Massachusetts.
