IP Litigator: Copyright Litigation
Verrill Dana attorney Rob Laplaca authored an article entitled "Copyright Litigation" in the March-April 2018 issue ofIP Litigator. The articles discusses the recently-decided case, Goldman V. Breitbart News Networks, and the legal implications of the court's ruling on the practice of "embedding" copyrighted material.
According to Rob Laplaca, the Goldman v. Breitbart News Network case provides Website owners and online publishers with several key takeaways, "At least according to the recent decision, allowing users to obtain content via embedding the content from another site will not save Website owners or individuals from a claim of copyright infringement. The lesson to learn: Talk to your IT people about how a user can access content from another site and consider providing users a link to copyrighted content whether they can access it for themselves, rather than embedding it from the other site."
