Verrill attorney Robert Keach recently spoke with Bloomberg Law regarding Judge Denise Cote’s decision to strike third-party releases in Gol Linhas Aéreas Inteligentes SA’s Chapter 11 plan—a ruling that challenges the prevailing view that silence equals consent and applies contract-law standards instead.
In the article, he noted, “You had a really clear trend toward opt-outs, with very few recent exceptions, so this is a speed bump. A lot of people were comfortably settling into that, so this is a bit of a shot across the bow, but it’s too early to make that conclusion.”
