We are trial lawyers who have represented clients in complex business disputes in state and federal trial and appellate courts, administrative tribunals, and alternative dispute resolution proceedings across the country. Our demonstrated ability and confidence to try cases are essential weapons in our arsenal, ready to be deployed when necessary to secure our clients’ interests.

There are cases in which a trial is necessary, but we know an early case analysis and strategic plan can provide the opportunity for an early successful resolution, avoiding litigation altogether. We work with our clients to develop a comprehensive plan to manage risk effectively, budget costs, and achieve their goals. Our legal teams are skilled in technology essential to preserve and collect evidence, control discovery costs, and educate and persuade the fact finder. They include holders of certificates issued by the nationally recognized Georgetown E-Discovery Training Academy.

Examples of the business cases we have litigated include:

        • Closely held technology corporation in direct and derivative actions brought by preferred stockholders who alleged a violation of their redemption rights and self-dealing by the CEO
        • National food producer against a distributor claiming wrongful termination of an exclusive distributorship agreement
        • Shanghai-based computer chip manufacturer in claims of patent infringement brought by a patent “troll”
        • Title insurance company in a class action seeking to enjoin the defendants from using allegedly unauthorized title agents, causing commissions to be diverted from authorized agents
        • National waste management company and its executives against claims of theft of trade secrets and breaches of noncompetition agreements brought by its competitor
        • Commercial property owners against claims for rescission of a real estate transaction and breach of a multimillion-dollar design/build construction contract
        • State’s largest health care administrator in a dispute relating to a joint venture to create a new commercial insurance product for employers throughout the state
        • Health care system in federal antitrust litigation, obtaining a dismissal before the commencement of discovery

The types of business and government regulatory disputes we have handled include:

        • Antitrust
        • Bankruptcy and creditor’s rights
        • Civil, Racketeer Influenced and Corrupt Organizations Act (RICO)
