        PFAS Regulatory Update: Dates You Need to Know

        Public Comment on the Federal Proposed Drinking Water Standards for Six PFAS Compounds

        On March 29, 2023, the U.S. Environmental Protection Agency (“EPA”), published in the Federal Register its proposed national drinking water standards for six PFAS compounds. Official publication of the proposed regulation comes on the heels of the Agency’s announcement on March 14, 2023, that it is proposing Maximum Contaminant Levels (MCLs) and Maximum Contaminant Level Goals (MCLGs) for PFOA, PFOS, PFNA, PFHxS, PFBS, and GenX Chemicals. Official publication of the proposed rule triggers the start of the public comment period, which will remain open until May 30, 2023. Members of the public are invited to comment on the proposed rule through the close of the comment period. The EPA is also holding a virtual public hearing on the proposed rule on May 4, 2023.

        Public Comment on Maine Chapter 90: Products Containing Perfluoroalkyl and Polyfluoroalkyl Substances

        On February 14, 2023, the Maine Department of Environmental Protection proposed its Chapter 90 rule, which provides draft regulations for the sale of goods containing intentionally added PFAS pursuant to 38 M.R.S. § 1614. The proposed rule will remain open for public comment until May 19, 2023, at 5:00pm. The Maine DEP will also hold a public hearing on April 20, 2023, at 9:00am at the Augusta Civic Center located at 76 Community Drive, Augusta, Maine.
