Verrill attorney Robert Keach was recently quoted in a Law360 article discussing federal legislation that would permanently restore the $7.5 million debt eligibility threshold for businesses seeking relief under Subchapter V of Chapter 11 of the Bankruptcy Code.
In the article, “Senate Bill Aims To Expand Small Biz Ch. 11 At Critical Time,” Keach explained that increasing the Subchapter V debt cap was important even before the COVID-19 pandemic, noting that the original eligibility threshold was lower than many restructuring professionals had advocated for when the legislation was developed. He also discussed the economic pressures facing small businesses, including inflation, tariffs, and other macroeconomic challenges.
Keach, a member of Verrill’s Bankruptcy & Creditors’ Rights Group, served as co-chair of an American Bankruptcy Institute commission whose recommendations helped shape the legislation that created Subchapter V.
