In the article,“The ‘Melting S’More’ Of SIMAD’s Summer Camp Ch. 11 Sale,” Keach discussed the challenges associated with selling seasonal businesses under an accelerated timeline. He noted that secured creditors are often concerned about preserving asset value and avoiding delays that could negatively affect sale outcomes, explaining that “the secured parties or senior creditors are most concerned about there not being a devaluation in the assets for waiting too long.” He also explained that while private sales do occur in bankruptcy cases, they are generally the exception rather than the rule.
He further noted the highly competitive nature of the summer camp industry and the significance of consumer confidence in preserving a camp’s value and operations.
