This program will explore the legal implications of causing marketing promotions and, in particular, the legal requirements for charitable sales promotions/commercial co-ventures. This course will also review the requirements for compliance with the new California and Hawaii laws governing online charitable solicitations.

Specifically, this program will provide a primer on the state law requirements for contracting, advertising, and registration of commercial co-ventures, as well as review a charity’s obligations and advertising limitations, and provide practical solutions for typical issues involved in these promotions. The program will also address other regulated entities, such as professional fundraisers, fundraising counsel, and charitable trustees.

        Learning Objectives:

        1. Identify a commercial co-venture

        2. Draft contracts between the brand and the charity that are compliant with state CCV laws

        3. Draft advertising for commercial co-venture promotions

        4. Identify the states where registration of CCVs is required

        5. Identify cause marketing programs that must comply with new charitable fundraising platform laws
